How do things work in te United States? If someone were to shoot an unarmed burglar who had broken into his house could/would he be prosecuted?

Well this wasn't a false alarm it was a real alarm. I have no problem paying $14.99/mth so it makes myself and my wife feel safer at night.
The wife left at like 4:45am this morning. I had originally thought that perhaps they saw her leave and thought the house was empty, but then it doesn't make any sense for them to wait another 3 hours, till when it gets daylight to kick the door in.
And chances that whoever broke in wasn't armed either, but that wouldn't stop me from putting a bullet in their head.
FWIW the cops arrived probably 15 min after the alarm went off. The security people called like 45 seconds after the alarm went off, I answered told them that someone had kicked in and they phoned the police. The police precinct the called me to let me know someone was on the way, he arrived probably 10 min later. He was here all of 5 minutes, finding out any info i had on the burgers and how much the TV they stole cost. He said a detective would be contacting me in a couple of days to find out if I had anymore info.
